“we send the message that this is the law.”  wrote Kathleen Toomey, MD PhD in her position as the Commissioner of the Georgia State Department of Public Health.    She would go on to architect a fraudulent backstory created, for a board complaint,  to get the doctors license revoked.   All the while the participants were also aware of another conclusion by DPH,,,,   “there is nothing we can do legally…..   He has done nothing wrong….”

Yet, the DPH conspirators began their work as instructed by Dr. Toomey on Nov 13, 2019! While the doctor remained unawares.

An alarming series of events then unfolded within the Georgia State Department of Public Health and in collusion with the GA-AAP.   The violations of law and potential abuses of power threaten the integrity of our healthcare system. At the heart of this controversy is Dr. Kathleen Toomey, orchestrated a campaign to unjustly revoke a physician's license, leveraging her position to enforce authority beyond legal bounds. 

This is not just about one individual but highlights systemic issues that could affect us all. The evidence, laid out in chronological order, chronicles a disturbing tale of collusion, deceit, and harassment that undermines the core values of justice and transparency.

It seems clear from just a review of timeline events as Dr. Toomey plan evolved.   You can read the frustration as “Team Corruption” found ways to bypass bothersome facts they themselves had concluded:

               “he has done nothing wrong” 

“there is nothing we can do legally”

They had no legal options against the good doctor.     So Dr. Toomey implemented the opotions she did have.   The illegal ones.     Dr. Toomey was going to have the doctors license revoked come hell or the high water….    

Now every member involved in her conspiracy knew it was baseless,  yet obeyed Dr. Toomey malignant instructions.

Background:

In the days before this email a case of measles was suspected at the doctor’s practice.   It was properly reported and the practice went above and beyond to assist DPH in their contact tracing efforts.    The DPH team “thanked both the doctor and his staff several times during DPH investigation.    Not a single concern was raised that was not immediately resolved by the good doctor.    Despite this being a undisputed fact;    the following unfolded:

12:37PM.        “Cherie has briefed Dr. Toomey on the <redacted by GA DPH>  We will keep you posted”

12:52PM.      “Dr. Toomey is going to reach out to Dr. Memark on the issue”.    

12:59PM.       Rick Ward as the Executive Director of the GA Academy of Pediatrics becomes involved

Mr. Ward exchanges ideas on how to illegally harass the unsuspecting doctor.   

Mr Ward’s discussions included:

        Use Criminal statues despite having no facts to support them

         Subject the unsuspecting doc to up to a year in jail or probation based on corrupt charges

Dec 6, 2019 -  Official GA-DPH Measles Investigation Concludes:         Successfully .

Not a single significant problem or concern is reported and the case if officially closed.

Dec 12, 2019 -  Cherie Drenzek (DPH) emails the team:

“Dr. Toomey asked if we could now work on putting together documentation in writing about the ped office/pediatrician lack of cooperation in the measles investigation.   They want to submit at “complaint” to the medical board….”                      

Dec 16, 2019 @ 10:24AM – Janet Memark District Health Director Cobb/Douglass GA-DPH

“Dr. Toomey just called me.   ….    The state will forward the report to the Composite board.”

Dec 16, 2019 4:22PM – Sheila Lovett (GA-DPH)

“we had the IRC complete a compliance site visit and they passed without any issues.

we found nothing out of compliance.    Does she (Dr. Toomey) want us to terminate him from the Vaccines for Children’s program(VFC).

The provider is also vaccinating according to the ACIP recommendations.

Dec 19, 2019 2:31PM -    Sheila Lovett (GA-DPH) reports to the team:

-                “there wasn’t anything we could do legally”

-                “no signs of noncompliance”

-                “The provider reports and complies with VFC requirements in his provider agreement”

-                “there are no requirement to assist in an investigation”

-                “there is not much we can do from the VFC standpoint.    However, if a complaint is made to the medical review board, and the physicians license is affected, the provider will no longer be eligible…”

Dec 19, 2019 -  2:41PM – Chris Rustin (GA-DPH) emails:

-                “Thanks for the update.  I plan to discuss with DR. Toomey tomorrow.   

Dec 20, 2019 @1:18PM -  Deanna Crosby confirms:

-                “No VFC violation documentation to be found”

During this time Dr. Toomey got Rick Ward GA-AAP to help by:

-                contacting the largest pediatric hospital network in the state, and get their help

to “see what they could do…..”

-                Spreading Dr. Toomey’s false narrative to many local pediatricians employed at CHOA              

-                Contacting the independent practice organization where the practice is a shareholding member

          to ask for their help to “see what they could do…..”

Dec 23, 2019 @3:55PM.  DPH emailed the generic email of provider’s practice:

“Your facility may be in violation of the VFC provider agreement”

“Based on information obtained during an outbreak investigation, it was determined that your facility may be in violation of the VFC Provider agreement.    Your site has been placed on suspension from the VFC program pending a thorough investigation”

Charge One: 

Failure to comply with immunization schedules, dosages, and contraindications that are established by the Advisory Committee on Immunization Practices (ACIP).

Charge two:

Failure to cooperate with state and local public officials conducting outbreak investigation.

“The practice did report the original suspect measles case to us(DPH)”

“The healthcare provider did not physically see all of these children”

“we (DPH) did not think it was suspicious for measles… and did not recommend testing”

Our opinion / Summary:

The fact speak for themselves:

-                Shows Dr. Toomey abusing her office, and enforcing authority DPH does not have.

-                egregious & blatant abuse of power with Dr. Toomey the clear architect

-                egregious & blatant abuse of power by every DPH employee who knew it was wrong

-                Misuse of the Federal VFC program,  illegally weaponizing it.

-                Violated privacy laws by colluding with Rick Ward of the GA-AAP
